2. Products
Pro meter Shop primarily supplies digital professional publications in PDF format relating to metrology, custody transfer measurement, measurement assurance, engineering practice and professional training.
Depending on the product, the customer may purchase:
- Public Professional Edition;
- NDA Expert Edition;
- combined or supplementary digital packages specifically identified on the product page.
The relevant product page specifies the edition, language, number of pages, format, price, included files, access conditions and other product-specific information.
Where indicated, the current Pro meter EM Modules Catalogue may be supplied with the purchased product at no additional charge.
3. Professional and educational purpose
Pro meter EM Modules are professional engineering, educational, training and reference materials.
They are intended for:
- professional education and training;
- internal company training;
- engineering reference;
- professional development;
- study and methodological work.
The materials may be used by engineers and organisations in their professional activities as a source of knowledge and reference.
Standards, regulations, technical requirements and industry practices may change. The customer remains responsible for confirming that any information relied upon for an actual engineering or commercial project is current and applicable.
4. Licence and permitted use
Unless expressly agreed otherwise in writing, purchase of a Pro meter digital product grants the purchaser a limited, non-exclusive and non-transferable licence to use the supplied material for the purchaser's own internal professional, educational, training and reference purposes.
Purchase of a digital publication does not transfer copyright, authorship or ownership of the intellectual property contained in it.
The purchaser may store the purchased files on devices reasonably required for the purchaser's authorised use.
5. Prohibited use and redistribution
Without prior written permission from Pro meter SIA, the purchaser may not:
- resell the purchased files;
- sublicense the purchased files;
- forward or otherwise transfer the files to third parties;
- upload the files to shared libraries, public cloud folders, forums or file-sharing services;
- publish the files in whole or in substantial part;
- reproduce the material for commercial distribution;
- include substantial parts of the publication in products, publications, courses or materials offered to third parties;
- remove copyright, authorship or Pro meter identification;
- make the purchased files publicly accessible;
- use the purchased digital content itself as a product for resale or other unauthorised commercial exploitation.
This restriction does not prevent engineers or organisations from applying knowledge acquired from the materials in their own professional work, provided that such use is independently verified and does not involve unauthorised reproduction or distribution of Pro meter content.
6. NDA Expert Editions
NDA Expert Editions may contain additional professional, technical, methodological or commercially sensitive material and are supplied subject to the applicable Pro meter confidentiality procedure.
Payment for an NDA Expert Edition does not by itself waive or replace the NDA requirement.
Where an NDA is required, access to the NDA Expert Edition is granted only after the applicable NDA has been completed and accepted by Pro meter SIA.
The relevant product page will identify products for which NDA completion is required.
7. Prices and taxes
Unless otherwise stated, prices displayed in Pro meter Shop are entered exclusive of VAT/PVN.
Where applicable, VAT/PVN or another applicable tax is calculated during Checkout based on the customer's billing information and the tax rules applicable to the transaction.
Before placing the order, the customer is shown:
- product price;
- applicable VAT/PVN or other tax, where applicable;
- total amount payable.
8. Payment methods
8.1 Payment card
Card payments are processed through the payment provider available in Pro meter Shop.
Following successful payment authorisation, the order may proceed automatically to completion, subject to any product-specific conditions.
8.2 Direct Bank Transfer
Where Direct Bank Transfer is selected, the customer receives payment instructions and, where applicable, a Proforma Invoice.
The order remains pending or on hold until payment is received and confirmed by Pro meter SIA.
Digital download access is not normally released before receipt and confirmation of payment.
9. Proforma Invoice and Invoice
Depending on the payment method and order status, Pro meter may issue:
- Proforma Invoice — payment request issued before confirmed payment, including Direct Bank Transfer orders;
- Invoice — issued following payment and confirmation of the completed sale.
Commercial documents may be issued electronically and do not require a paper original unless applicable mandatory law specifically requires otherwise.
10. Digital delivery
Public digital products are normally made available electronically following successful payment and completion of the order.
The customer receives access to the purchased files by electronic means, including a download link where applicable.
Download limits and expiry periods, if applicable, are stated on the product page or in the order information.
Where an additional Pro meter EM Modules Catalogue is included with the purchased product, it is supplied at no additional charge.
Delivery of an NDA Expert Edition may additionally depend upon completion of the applicable NDA procedure.
11. Digital content and right of withdrawal
Where the customer is a consumer and mandatory consumer-protection legislation applies, statutory rights relating to distance contracts remain applicable.
Where digital content is supplied electronically before expiry of an applicable statutory withdrawal period, immediate supply may require the consumer's prior express consent and acknowledgement that the statutory right of withdrawal may be lost once supply of the digital content begins, to the extent provided by applicable law.
12. Refunds and delivery problems
Nothing in these Terms limits mandatory rights granted to consumers by applicable law.
Where immediate supply of digital content has lawfully commenced following the customer's express consent and acknowledgement, the statutory withdrawal right may no longer apply in accordance with applicable law.
If a purchased file is defective, inaccessible, incomplete or incorrectly supplied, the customer should contact:
Pro meter will investigate the issue and, where appropriate, restore access, replace the file or provide another remedy required by applicable law.
13. Intellectual property
Unless expressly stated otherwise, copyright, technical content, diagrams, methodologies, texts, training materials and other intellectual property contained in Pro meter publications remain the property of Pro meter SIA and/or their respective lawful rights holders.
No intellectual property rights are transferred merely because a customer purchases a copy of a publication.
14. Technical and professional responsibility
Pro meter publications may include practical examples, engineering methodologies, historical references and references to standards, regulations or industry practices.
The customer is responsible for confirming the current edition, validity and applicability of standards, regulations, contractual requirements and technical data before using information in an actual engineering, metrological, contractual, legal or commercial decision.
Pro meter publications are professional educational and reference materials and are not a substitute for project-specific engineering verification.
15. Customer information
The customer is responsible for providing accurate billing, contact, company and tax information.
Where a customer requests EU B2B treatment, reverse-charge treatment or another specific tax treatment, Pro meter may request additional company or VAT identification information and may verify that information through the applicable official systems.
16. Privacy and payment information
Personal data is processed in accordance with the Pro meter Privacy Policy and applicable data-protection legislation.
Payment-card information is processed through the applicable payment service provider and is not intended to be stored directly by Pro meter except as technically and legally provided by the payment system.
17. Changes to products and documentation
Pro meter may update, revise or replace digital publications, catalogues, editions, product descriptions and supporting documentation.
A customer's purchase relates to the edition and package identified in the applicable order unless otherwise expressly stated.
18. Applicable law
These Terms and Conditions are governed by the laws applicable to Pro meter SIA in Latvia, without limiting any mandatory consumer rights which may apply under European Union law or other mandatory legislation.
